AD/CV Notices
Following are summaries of current AD/CV actions targeting mainland Chinese manufacturers taken by the DOC.
Product: Cast iron soil pipe, classified under HTSUS subheading 7303.00.0030.
Nature of Notice: Preliminary affirmative determination and alignment of final AD and CV determinations in CV investigation C-570-080, effective 2 July 2018.

Summary: The DOC has preliminarily established the following subsidy rates for imports of subject merchandise. The DOC will instruct CBP to begin collecting CV cash deposits on imports of subject merchandise at these rates. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue a CV duty order and require CV cash deposits at the rates specified therein, which could be different from those set forth below.

Summary: In its administrative review of subject merchandise for the period 1 November 2016 through 31 October 2017, the DOC has preliminarily determined that Baosteel Group Corporation, Shanghai Baosteel International Economic & Trading Co. Ltd., Baoshan Iron and Steel Co. Ltd., Shanghai Meishan Iron & Steel and Union Steel China have not demonstrated that they are separate from the China-wide entity. If these results are confirmed, imports of subject merchandise from these companies will be subject to the current China-wide rate of 90.83 percent.

Summary: Each year during the anniversary month of the publication of an AD/CV duty order, finding or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request, by 31 July, administrative reviews of the AD duty orders on the following products from mainland China for the period 1 July 2017 through 30 June 2018: carbon steel butt-weld pipe fittings (A-570-814), certain potassium phosphate salts (A-570-962), certain steel grating (A-570-947), circular welded carbon quality steel pipe (A-570-910), cold-rolled steel flat products (A-570-029), corrosion-resistant steel products (A-570-026), persulfates (A-570-847) and xanthan gum (A-570-985). Parties may also request reviews of the following CV duty orders for the period 1 January through 31 December 2017: certain potassium phosphate salts (C-570-963), certain steel grating (C-570-948), circular welded carbon quality steel pipe (C-570-911), cold-rolled steel flat products (C-570-030), corrosion-resistant steel products (C-570-027) and pre-stressed concrete steel wire strand (C-570-946). These reviews could result in (a) revised AD/CV duty assessments for entries of subject merchandise made during the period of review and (b) revised AD/CV duty cash deposit rates for entries made after completion of the reviews.

Summary: The DOC has rescinded its review of subject merchandise exported during the period 1 February 2016 through 31 January 2017 because the requesting parties withdrew their review requests. As a result, the cash deposit rates for subject merchandise will continue to be the rates established in the most recently completed administrative review.

Summary: The DOC has amended the final results of its administrative review of subject merchandise for the period 1 August 2009 through 31 July 2010 after the U.S. Court of International Trade sustained its final remand redetermination. As a result, the dumping margins for Tianjin Jinchi Metal Products Co. Ltd., Tianjin Jinghai County Hongli Industry & Business Co. and the separate rate companies have been amended from 47.76 percent, 78.27 percent and 19.30 percent, respectively, to 36.23 percent, 53.47 percent and 14.48 percent, respectively. In the event that the court’s ruling is not appealed or, if appealed, is upheld by a final and conclusive court decision, the DOC will instruct CBP to assess AD duties on unliquidated entries of subject merchandise based on the revised rates.

Summary: The DOC has initiated a new shipper review of subject merchandise produced and exported by Jinxiang Infang Fruit & Vegetable Co. Ltd. during the period 1 November 2017 through 31 May 2018. The review will indicate whether the DOC is likely to establish a separate AD rate for this company.

Summary: The DOC has published the following list of scope rulings completed between 1 April and 30 June 2017. Scope rulings serve to determine whether a particular product is within the scope of an AD and/or CV duty order. Scope issues typically arise in cases where the descriptions of subject merchandise contained in the DOC’s determinations are ambiguous. It is also possible that, as technology evolves and new products are created, these new products may fall outside the scope of the order.
