The DOC has also preliminarily determined that 16 producer/exporters made no shipments of subject merchandise during the period of review and that Jinqiao Flooring Group Co. Ltd. is not eligible for a separate rate and therefore remains part of the China-wide entity. Finally, the DOC has rescinded its review of Dalian Penghong Floor Products Co. Ltd. because the review requests for that company were timely withdrawn.

Product: Crystalline silicon photovoltaic cells, whether or not assembled into modules, classified under HTSUS subheadings 8501.31.8000, 8501.61.0000, 8507.20.80, 8541.40.6020 and 8541.40.6030.
Nature of Notice: Final results of changed circumstances review and partial revocation of AD and CV duty orders in AD investigation A-570-979 and CV investigation C-570-980, effective 18 January 2018.

Summary: The DOC has determined that these orders should be revoked with respect to certain solar panels of a sufficiently small size, voltage, amperage and wattage, among other characteristics. Accordingly, the orders now exclude panels with a surface area from 3,450 mm2 to 33,782 mm2, with one black wire and one red wire (each of type 22 AWG or 24 AWG not more than 206 mm in length when measured from panel extrusion), and not exceeding 2.9 volts, 1.1 amps and 3.19 watts. No panel may contain an internal battery or external computer peripheral ports.

Nature of Notice: Postponement of preliminary determination in CV investigation C-570-074.

Summary: The DOC has decided to postpone its preliminary determination in this investigation from 1 February to 9 April. The preliminary determination will indicate whether the DOC is likely to establish CV duties on imports of subject merchandise.

Product: Cast iron soil pipe fittings, classified under HTSUS subheading 7307.11.0045.
Nature of Notice: Amended preliminary affirmative determination in CV investigation C-570-063, effective 19 January 2018.

Summary: The DOC published its preliminary determination in this investigation on 19 December 2017. A day earlier a respondent submitted ministerial error allegations and the DOC has now decided to amend the preliminary subsidy rates, as shown below. If both the DOC and the USITC issue affirmative final determinations in this case, the DOC will issue a CV duty order and require CV cash deposits at the rates specified therein, which could be different from those set forth below.

Summary: In the final results of its administrative review of the AD duty order on subject merchandise for the period 1 December 2015 through 30 November 2016, the DOC has determined that Tianjin Tonghe Stationery Industrial Co. Ltd. and the mandatory respondent Ningbo Homey Union Co. Ltd. are not eligible for separate rates and therefore remain part of the China-wide entity. The DOC has also determined that the entity comprised of Wah Yuen Stationery Co. Ltd. and Shandong Wah Yuen Stationery Co. Ltd. had no shipments of subject merchandise during the POR.

Summary: The scope of these investigations covers certain plastic decorative ribbon having a width (measured at the narrowest span of the ribbon) of less than or equal to four inches in actual measurement, including ribbon wound onto itself; a spool, a core or a tube (with or without flanges); attached to a card or strip; wound into a keg- or egg-shaped configuration; made into bows, bow-like items, or other shapes or configurations; and whether or not packaged or labelled for retail sale. The subject merchandise is typically made of substrates of polypropylene but may be made in whole or in part of any type of plastic, including plastic derived from petroleum products and plastic derived from cellulose products.

The proceedings cover ribbons comprised of one or more layers of substrates made, in whole or in part, of plastics adhered to each other, regardless of the method used to adhere the layers together, including ribbons comprised of layers of substrates adhered to each other through a lamination process. Subject merchandise also includes ribbons comprised of one or more layers of substrates made, in whole or in part, of plastics adhered to one or more layers of substrates made, in whole or in part, of non-plastic materials, including substrates made, in whole or in part, of fabric.

The ribbons subject to these investigations may be of any colour or combination of colours (including ribbons that are transparent, translucent or opaque) and may or may not bear words or images, including those of a holiday motif. The subject merchandise includes ribbons with embellishments and/or treatments, including ribbons that are printed, hot-stamped, coated, laminated, flocked, crimped, die-cut, embossed (or that otherwise have impressed designs, images, words or patterns), as well as ribbons with holographic, metallic, glitter or iridescent finishes. Subject merchandise includes “pull-bows,” an assemblage of ribbons connected to one another, folded flat, and equipped with a means to form such ribbons into the shape of a bow by pulling on a length of material affixed to such assemblage, as well as “pre-notched” bows, an assemblage of notched ribbon loops arranged one inside the other with the notches in alignment and affixed to each other where notched, and which the end user forms into a bow by separating and spreading the loops circularly around the notches that form the centre of the bow. Subject merchandise includes ribbons that are packaged with non-subject merchandise, including ensembles that include ribbons and other products such as gift wrap, gift bags, gift tags and/or other gift packaging products.

Excluded from the scope of these investigations are (i) ribbons formed exclusively by weaving plastic threads together; (ii) ribbons that have metal wire in, on, or along the entirety of each of the longitudinal edges of the ribbon; (iii) ribbons with an adhesive coating covering the entire span between the longitudinal edges of the ribbon for the entire length of the ribbon; (iv) ribbon formed into a bow without a tab or other means for attaching the bow to an object using adhesives, where the bow has an outer layer that is either flocked or made of fabric and a flexible metal wire at the base that is suitable for attaching the bow to a Christmas tree or other object by twist-tying; (v) elastic ribbons, meaning ribbons that elongate when stretched and return to their original dimension when the stretching load is removed; (vi) ribbons affixed as a decorative detail to non-subject merchandise, such as a gift bag, gift box, gift tin, greeting card or plush toy, or affixed (including by tying) as a decorative detail to packaging containing non-subject merchandise; (vii) ribbons that are (a) affixed to non-subject merchandise as a working component of such non-subject merchandise, such as where the ribbon comprises a book marker, bag cinch, or part of an identity card holder, or (b) affixed (including by tying) to non-subject merchandise as a working component that holds or packages such non-subject merchandise or attaches packaging or labelling to such non-subject merchandise, such as a “belly band” around a pair of pyjamas, a pair of socks or a blanket; (viii) imitation raffia made of plastics having a thickness not more than one mil when measured in an unfolded/untwisted state; and (ix) ribbons in the form of bows having a diameter of less than seven-eighths of an inch, or having a diameter of more than 16 inches, based on actual measurement. Also excluded are any products covered by the existing AD duty order on polyethylene terephthalate film, sheet and strip.

The USITC will issue its preliminary injury determination by 12 February (a vote has been scheduled for 9 February).

Nature of Notice: Court decision not in harmony with final results of administrative review in AD investigation A-570-836, effective 26 January 2018.

Summary: The DOC has amended the final results of its administrative review of subject merchandise for the period 1 March 2010 through 28 February 2011 after the U.S. Court of International Trade sustained its final remand redetermination. As a result, the DOC has assigned an amended weighted-average dumping margin of zero to Baoding Mantong Fine Chemistry Co. Ltd. In the event the CIT’s ruling is not appealed or, if appealed, upheld by a final and conclusive court decision, the DOC will instruct CBP to assess AD duties on unliquidated entries of subject merchandise with respect to this company.
